These Terms of Use (“Terms”) govern access to and use of the BuyOne mobile app and related websites, services, features, and content provided by SIA “BUYONE”, Reg. No. 40203518800, Legal Address: Brīvības gatve 342-33, Rīga, LV-1006, Latvia (hereinafter “BuyOne”, “we”, “us”, “our”).

By using the BuyOne app, you confirm that you have read, understood, and agree to these Terms. If you do not agree with any of these provisions, you must stop using the app immediately.

BuyOne is a digital platform that allows users to post listings and make service-related transactions, such as business consultations, training, sports coaching, shared activities, and other forms of interaction.

2. ELIGIBILITY

• Users must be at least 18 years old.
• You must provide truthful, up-to-date, and complete information during registration and keep it current.
• You are responsible for safeguarding your login credentials.
• You agree to use BuyOne only for lawful purposes.

3. SERVICE DESCRIPTION

BuyOne provides a technology platform that allows users to create and publish their own offers, purchase tickets and services from other users via integrated payment systems, and communicate within the app.

BuyOne is not a party to agreements between users and is not responsible for fulfilling agreements, the quality of interaction, or the behavior of the parties.

4. CODE OF CONDUCT

Using BuyOne for illegal, offensive, or fraudulent activities is prohibited, including posting content that contains pornography, violence, racism, threats, or third-party advertising.

BuyOne reserves the right to remove such content or block a user in case of violations, including breaches of this policy.

5. CONTENT RIGHTS

• Users retain all rights to their own content but grant SIA “BUYONE” a non-exclusive license to use, store, and display such content to operate and promote the service.
• All elements of the app (text, design, logos, code) are the property of BuyOne and are protected by copyright.

6. PAYMENTS, COMMISSIONS AND REFUNDS

6.1. General Terms

1. All payments within the BuyOne app are processed via secure payment services, including Stripe, Apple Pay, and Google Pay.
2. Payments are made via credit/debit card or other available methods at the time of checkout.
3. By confirming payment, the user enters into a digital contract with another user (event organizer) mediated by BuyOne.
4. BuyOne does not store card data — it is processed exclusively by payment partners in accordance with PCI DSS and GDPR standards.

6.2. BuyOne Commission

1. BuyOne retains a 20% commission from each successful transaction.
2. This commission includes all fees related to payment processing (including Stripe, Apple, Google, and other partner fees).
3. The remaining 80% is transferred to the event organizer after the service or event takes place.
4. The BuyOne commission is non-refundable, except as described in the refunds section.

6.3. Event Confirmation and Payment Process

1. The organizer must confirm the user’s participation.
2. Upon confirmation, the user is required to make payment using Apple Pay, Google Pay, or a bank card via the app.
3. Payment serves as confirmation of intent to participate and acceptance of the organizer’s terms.
4. If not confirmed by the organizer, the payment is not charged.

6.4. Event Completion Confirmation and Automatic Payments

1. After the event begins, the participant must confirm in the app that the event occurred, using a designated button or notification.
2. Once confirmed, the event is considered completed, and the payment system is instructed to transfer funds to the organizer.
3. If the participant does not confirm, but no complaint is received within 48 hours after the event time, the payment is automatically released to the organizer.
4. If a complaint is received within 48 hours, the payment is paused until BuyOne support investigates.
5. If the participant did not attend the event without canceling, the payment is not refunded and is transferred to the organizer after 48 hours.

6.5. Right of Withdrawal and Refunds

1. According to EU Directive 2011/83/EU (implemented in Latvia via the Consumer Rights Protection Law), EEA users have the right to cancel a digital purchase within 14 days if the service has not yet been fully provided.
2. When booking an event with a specific date/time, the user agrees that the service begins at a fixed moment, so the 14-day withdrawal right does not apply if fewer than 24 hours remain.
3. Users may cancel participation no later than 24 hours before the event, unless local laws state otherwise.
4. To cancel, email support@buyone.me with your name, email, date and title of the event, and reason for cancellation.
5. If the cancellation is made on time, the amount is refunded within 5–10 business days using the original payment method.
6. If canceled with less than 24 hours’ notice or in case of a no-show, no refund is issued.
7. The BuyOne commission and partner processing fees (Stripe, Apple, Google) are non-refundable if the event is not canceled on time.

6.6. Disputes and Mistaken Charges

1. In case of an incorrect charge or unfulfilled service, users may file a complaint by contacting BuyOne support and including proof of payment and a description.
2. All requests are reviewed within 10 business days.
3. If the error is confirmed, the amount is fully refunded to the original payment method.
4. BuyOne reserves the right to deny a refund if records show the service was delivered or confirmed.

6.7. Organizer Obligations

1. The organizer (user receiving payment) must confirm and provide the service at the agreed time.
2. In case of unjustified cancellation or failure to deliver the service, BuyOne may refund the participant and deduct the commission from future payouts to the organizer.
3. Organizers must comply with local laws, including tax obligations and data protection requirements.

7. REFUNDS AND RIGHT OF WITHDRAWAL

All purchases are non-refundable unless required by law.

EEA users may cancel subscriptions within 14 days if the service has not yet been fully provided.

Refund requests must be sent to support@buyone.me.

8. PRIVACY

BuyOne processes personal data in accordance with the GDPR.

9. SAFETY AND MEETINGS

BuyOne does not verify users’ identities and is not liable for their behavior.

All meetings are initiated by the users and happen at their own risk.

10. LIABILITY

The service is provided “as is”.

BuyOne does not guarantee uninterrupted access or error-free operation.

Maximum liability is limited to €100 or the total commissions collected from the user’s payments in the past 12 months.

11. GOVERNING LAW AND DISPUTES

These Terms are governed by Latvian law.

Disputes are resolved through negotiations or in court at the legal address of BuyOne.
